Case called several times since morning, but none has put in appearance on behalf of complainant. It is already 3.40 pm. Further wait is not justified. Moreover, it is observed that the respondent has moved an application under order 7 rule 11 CPC for dismissal of the complaint. But the complainant has not filed its reply despite availing many opportunities including last one and has also filed to make opportunities including last one and has also failed to make payment of cost. Further more. On the last date of hearing i.e. 3.4.2019 none has appeared on behalf of the complainant. In these circumstances, it appears that the complainant is least interested in pursuing the present complaint. Accordingly, the present complaint is dismissed in default for non-prosecution.
