Present Counsel for the complainant andMs. Esha Verma, Counsel for OPand filed compromise dated 14.12.2019 which has been attested by this Forum. Hence looking to the terms of compromise Exh-1, we therefore direct OP torefund Rs.26,813/-which is 75% of IDV of the vehicle as full & final settlement to the complainant within 30 days from the date of order. The complainant will give documents i.e. Form No.28, 29, 30 & Form No.35 with NOC to OP and the complainant further to provide affidavit and Indemnity Bond to OP after receiving cheque/DD.
This order shall be complied with by OP within a period of 30 days from the date of this order failing which an additional interest @ 10% per annum will be payable on whole of above amount from the date of this order till payment to the complainant. The case of the complainant is disposed of as settled. File be consigned to record room.
