During the course of arguments, it has been pointed out by the counsel for the opposite party No.1 that complainant did not produce some documents which were necessary for the process of the claim case of the complainant by the opposite party No.1. It has been pointed out by Sh.Rohit Kapoor, Investigator in his affidavit ex.OP1/5 that complainant did not submit the following documents :-

  1. Address proof

  2. Untraced report

  3. Original R.C.

  4. Copy of driving licence

  5. Purchase invoice of the vehicle

  6. Form No.28 & 29

Opposite party No.1 is ready to settle the claim case of the complainant within one month from the receipt of the aforesaid documents.

We have discussed the matter and have gone through the record.

Opposite party No.1 cannot ask the address proof from the complainant nor can claim original RC of the vehicle of the complainant unless and until they decide the claim case of the complainant. Complainant is liable to transfer the RC of the vehicle in favour of the opposite party No.1 after passing of the claim case of the complainant. Copy of the driving licence is not required in case of theft of the vehicle nor the complainant is liable to produce the purchase invoice of the vehicle to the opposite party No.1. However, complainant is liable to fill in and sign form No.28 and 29 in favour of the opposite party No.1. Opposite party No.1 can get transferred the vehicle after passing of the claim case of the complainant. So, complainant is required to furnish untraced report of the vehicle, fill in and sign the form No.28 and 29 as per the requirement of the opposite party No.1 through their investigator Sh.Rohit Kapoor. So, complainant has stated at bar that he is ready to furnish these documents.

Hence, this complaint is disposed of with directions to the complainant to furnish untraced report and fill in and sign the form No.28 and 29 in favour of opposite party No.1 within seven days from today and opposite party No.1 is directed to settle the claim case of the complainant within one month from the receipt of the aforesaid documents from the complainant. Keeping in view the peculiar circumstances of the case, parties are left to bear their own costs. Copy of the order be furnished to the parties free of costs. File is ordered to be consigned to the record room.
