ORDER

Rakesh Kumar Versus ICICI .

CC No. 35 of 2014.

 

Present: Sh. Anuj Kamboj, Advocate, counsel for complainant. 

              Sh. Parmod Gupta, Advocate, counsel for OP.

 

                        Today the case was fixed for arguments. However, learned counsel for the OP offered an amount of Rs. 24,500/- as a full and final payment against the theft of motorcycle bearing registration No. HR-02W-6992 which was insured with the OPs Insurance Company vide insurance policy bearing No. 3005/74440570/00/B00 dated 13.10.2012 for a sum insured of Rs. 28,629/- subject to submission of subrogation letter, indemnity bond and form No.29 & 30 which are required for transfer of Registration Certificate and same has been accepted by the counsel for the complainant. Statements of both the parties have been recorded separately.

                        In view of the statements of both the parties, the present complaint of the complainant is hereby partly allowed in terms of compromise between the parties. The OP is directed to pay a sum of Rs. 24,500/- as full and final payment within a period of 45 days subject to submission of subrogation letter, indemnity bond and form No.29 & 30 which are required for transfer of Registration Certificate otherwise complainant is at liberty to invoke the jurisdiction of this Forum as per law. Parties are bound by their statements recorded in the Forum. Copies of this order be sent to the parties concerned free of costs as per rules. File be consigned to the record room after due compliance.
