                   Today the case was fixed for arguments.  At this stage, Counsel for the complainant has made a separate statement in which he states that he wants to withdraw his present complaint on the technical ground of pecuniary jurisdiction  with liberty to file afresh before the appropriate authority.

                   Heard. In view of the statement, the present complaint is hereby dismissed as withdrawn with a liberty to file afresh before the appropriate authority. However, the complainant is at liberty to approach the appropriate Court/Forum on the same cause of action, if so advised. Further, the complainant would be entitled to the benefit of the provision of Section 14(2) of the limitation Act for the period during which proceeding under the Consumer Protection Act remained pending before this District Forum as per law laid down in case titled as “Luxmi Engineering Works Vs. P.S.G. Industrial Institute (1995) III, SCC Page-583. Copies of this order be sent to the parties concerned free of costs as per rules. File be consigned to the record room after due compliance.
