Final Order / Judgement

Present:          Complainant in person with counsel Sh. Sunil Sheoran, Adv.

                        Sh. Rajender Verma, Adv. for OP No.1.

                        Sh. Sushil Kumar, Adv. for OP No. 2.

           

                 File put up today on the application of complainant. The counsel for complainant has made a statement before this Commission that he wants to give up OP No.2 being unnecessary and further stated that they have compromised with OP No. 1 ICICI Lombard insurance company for a sum of Rs. 14,00,000/-which is full and final settlement.

                    The counsel for OP No.1 also made a similar statement that they have compromised with complainant for a sum of Rs. 14,00,000/- as full and final settlement and they will be bound to deposit the aforementioned amount before the Commission within a period of 60 days. Statements of the counsel for the parties in this regard have been recorded separately. 

                    Heard. In view of statement made by the counsel for complainant, the OP No. 2 is hereby given up and in view of similar statements made above by learned counsel for the both the parties whereby the OP No.1 stated to pay Rs. 14,00,000/-to the complainant as full and final settlement, within a period of 60 days, it is ordered accordingly with further clearance that in case, the OP No. 1 fails to pay the aforementioned amount of Rs. 14,00,000/-to the complainant within a period of 60 days from the date of this order, the OP No. 1 shall be further liable to pay an interest @ 9% p.a. to the complainant after the expiry of 60 days period, till realization of final payment to the complainant. The present complaint stands disposed off accordingly.

                     Certified copy of the order be supplied to the parties free of costs.

                   File be consigned to the record-room after due compliance.
