O R D E R

- During the course of proceedings the parties herein entered into an accord which was produced to writing and submitted before this Commission on 2/11/2023. As per the said accord, following are the conditions upon which the case is being settled.
- Complainant has handed over the key as well as original registration certificate pertaining to Honda Activa Scooter bearing Reg.No.KA-O5-LD-7143 alongwith cancelled cheque and an indemnity cum declaration undertaking that this complaint will be withdrawn.
- The opposite party has agreed to pay the complainant an amount of Rs.73,087/- (Rupees Seventy three thousand and eighty seven only) which the complainant has accepted to be in full satisfaction and final settlement of all her claims as against the opposite party.
- The aforesaid amount of Rs.73,087/- shall be paid by the opposite party to the complainant within a period of 20 clear days from 2/11/2023.
- In the event the aforesaid amount is not paid in accordance with the conditions in clause (iii) :
- The opposite party shall pay the aforesaid amount together with interest @10% from the date of claim raised by the complainant before the opposite party.
- The opposite party shall pay a cost of Rs.20,000/- to the complainant.
- In the event the aforesaid conditions in clauses (iv)(a) and (b) are not complied within 45 days of this order, the complainant shall be entitled to a solatium of Rs.500/- per month or part thereof from 02/11/2023 till date of payment.
(v) The memo of compromise signed by the counsel for opposite party shall form part of this order.
