O R D E R

            By  Sri. Vinay Menon V., President

 

  1. During the course of proceedings the parties herein entered into an accord  which was produced to writing and submitted before this Commission on 2/11/2023. As per the said accord,  following are the conditions upon which the case is being settled.
  1. Complainant has handed over the key as well as original registration certificate pertaining to Honda Activa Scooter bearing Reg.No.KA-O5-LD-7143 alongwith cancelled cheque and an indemnity cum declaration undertaking that this complaint will be withdrawn.
  2. The opposite party has agreed to pay the complainant an amount of Rs.73,087/- (Rupees Seventy three thousand and eighty seven only) which the complainant has accepted to be in full satisfaction and final settlement of all her claims as against the opposite party.
  3. The aforesaid amount of Rs.73,087/- shall be paid by the opposite party to the complainant within a period of 20  clear days from 2/11/2023.
  4. In the event the aforesaid amount is not paid in accordance with the conditions in clause (iii) :
  1. The opposite party shall pay  the aforesaid amount together with interest @10%  from the date of claim raised by the complainant before the opposite party.
  2. The opposite party shall pay a cost of Rs.20,000/- to the complainant.
  3. In the event the aforesaid conditions in clauses (iv)(a) and (b) are not complied within 45 days of this order, the complainant shall be entitled to a solatium of Rs.500/- per month or part thereof from 02/11/2023 till date of payment.

(v)              The memo of compromise signed by the counsel for opposite party shall form part of this order.

                         Pronounced in open court on this the  6th  day of November,  2023.
