This is an application filed under Order 1 Rule 10(2) read with Section 151 of the Code of Civil Procedure, 1908 for striking out the name of respondent No. 2 ( applicant herein ) from the array of the respondents in F.A. 10/2017.

              Heard Mr. M. Kashyap, learned counsel, appearing for the applicant/respondent No. 2. Also heard Mr. S. Bhuyan, learned counsel, appearing for the opposite party/appellant.

              Also perused the statement made on oath in the application. Mr. Bhuyan has submitted that they have no objection for striking out the name of the respondent No. 2. More so, in the judgment dated 17-6-2017 passed by the District Forum, Sonitpur, it is made clear that the opposite party No. 2 i.e. Tata Finance ( applicant herein) is no where connected with award.

              In view of the same, the prayer made in the application is allowed.

              Misc Case is allowed and disposed of accordingly.

              Office is directed to correct the cause title accordingly.
