Today is the date fixed for hearing of the instant case, if compromise fails.

 

The complainant files hazira through his ld. Advocate who has appeared before this forum.

         

The OP has also filed hazira through its ld. Advocate.

 

A compromise petition is filed supported by affidavit on the part of the OP with a prayer to dispose of the case on compromise on the ground that the claim has been settled out of the Forum in between the complainant and the OP for Rs. 3,20,000. to be paid to the complainant by the OP for which the OP issued a cheque no. 513855 dt. 09-07-2014 in favour of the complainant for Rs. 3,20,000. as compensation for own damage claim of insured vehicle bearing no. WB-31.3193 -Bus- and that the complainant after compromise shall have no  further claim against OPs with regard to the claim being no. MOT01255798 in respect of Policy no. 3004.53209892.01.000 for accident dt. 08.09.2009.

The complainant has also filed a separate petition of compromise supported by affidavit with a prayer to dispose of the case on compromise on the same self-grounds made in the compromise petition of the OP filed today. 

 

Heard both sides, seen and considered the aforesaid two compromise petitions filed today by the respective parties.

 

Considering the circumstances made in the said two compromise petitions of the parties, it is ordered that the instant case be and the same is allowed on compromise for issuance of the above mentioned cheque for Rs. 3,20,000. in favour of the complainant by the OP being agreed by the parties.  Let the said two compromise petitions filed today by the parties be treated as part of this order.

 

Later

 

On prayer of the complainant through a verified petition, the complainant is allowed to receive the said cheque on filing of proper receipt being identified by his lawyer.

 

The complainant has filed a receipt today which goes to show that the said cheque for Rs. 3,20,000. has been handed over to the complainant in presence of his ld. Advocate.

 

Let the receipt be kept in.with the record.
