The complaint is allowed.
OP is directed to deposit at this Forum sum of Rs. 5,03,775/-, (being the claim settlement due) together with simple interest @ 9% p.a. thereon from 12/10/2008 (being date of OPs letter rejecting the claim) till actual payment.
In case however, OP furnishes evidence that any amount has been paid by them to the financier of the vehicle. They can furnish such evidence and the sum awarded in ‘b’ above will stand reduced to that extent.
Complainant shall furnish evidence that the loan taken from financiar with whom the suit vehicle is/was hypothecated has been, fully paid back. Against this, office of this Forum is directed to pay sum received from OPs as per ‘b’ and ‘c’ above to Complainant.
Parties should comply with above directions within 60 days of date of this Order.
