COMPLAINT UNDER SECTION 35 OF THE CONSUMER PROTECTION ACT, 2019 AS AMENDED UPTO DATE

Present:-      Sh. Sanjay Kumar, Advocate, for the Complainant.

                   ShriSahilAbhi, Advocate, Counsel for OP.

                   File taken up on an application moved by the OP.

                   Ld. Counsel on the instructions of OP i.e. ICICI Lombard that the OP is ready to settle the matter making the payment of Rs 40,000/- in shape of Demand Draft in favour of the Complainant, as full and final settlement, within 30 days from today.

                   On the other hand, Ld. Counsel for theComplainant,by making a separate statement, states that he has gone through the statement made by the Ld. Counsel for the OP and agrees with the same if the payment is made with in stipulated time. If the payment is not made within 30 days, then in the event the Complainant shall be entitled to payment of interest @ 9 % P.A on the sttled amount of Rs. 40,000/- from today till its actual realization. heance,he withdraws the present complaint on behalf of Complainant.       

                    Heard. In view of the statements made by both the parties, the present Consumer Complaint is hereby dismissed as withdrawn. It is made clear that both the parties shall be bound by their respective statements. In case, the OP fails to comply with the statement made by the Ld. Counsel on its behalf, in that event, the Complainant shall be entitled to initiate proceedings under section 71/72 of the CP Act, 2019.             

                   A copy of this order be sent to the parties, free of costs and File be consigned to the record room, after due compliance.
