The applicant has filed Miscllaneous Application No.7 dated 25.8.2023 for releasing him payment of Rs.1,29,522/- alongwith upto date interest.
We have heard learned counsel for applicant and gone through the file and record on file carefully.
In case ICICI Lombard General Insurance Co. Ltd. Vs. Dr.Kanwaljeet Deol & Anr, R.P No.1154 of 2017 filed before Hon'ble National Consumer Disputes Redressal Commission, a joint application U/s 151 of CPC has been filed on behalf of both sides in which it has been made out that the respondent Nos.1 and 2 have agreed to accept an amount of Rs.1,29,522/- alongwith interest, if any, which has accrued upon such amount as full and final payment in dispute, on account of which, the Petitioner is no longer interested to pursue the Revision Petition.
In view of the facts mentioned in the application, Revision Petition was disposed of on the basis of compromise between the parties. Respondent No.1 was permitted to withdraw the amount deposited by the Petitioner alongwith accrued interest thereupon in the District Forum, Bathinda for himself and respondent No.2.
Report seen. So, after going through all the facts and version of applicant, the FDR of Rs.1,72,557/- (maturity amount) is ordered to be released to the applicant as per rules subject to identification, verification, Aadhaar card and account passbook. Office Superintendent is ordered to comply with the order. Thus, miscllaneous application stands disposed off and file be consigned to record room.
