Per Sri A. Hazarath Rao, President:

Counsel for the complainant filed memo to the following effect :

“The complainant is not pressing the above case at present reserving his right to file another CC afresh if necessary after 6at present reserving his right to file another CC afresh if necessary after submitting claim form. 

Consumer Forum can apply the provisions of CPC as enumerated in Section 13(4) of the Consumer Protection Act as laid down in WP.No.18735/08 dated 30-01-09 in (M/s.Sivashakthi Builders and another Vs. The A.P.State Consumer Disputes Redressal Commission, Hyderabad) and by the Supreme Court in Ethiopian Airlines Vs.G.N.Saboo2011 (8)SCC 539.

Under those circumstances, this Forum cannot give liberty to the complainant to file fresh consumer case. 

In the result the complaint is dismissed as not pressed.
