Final Order / Judgement

Order No.23, Dated 24.12.2020;  

     Today is fixed for filing show cause by the opposite party No.3 as to why the case shall not be proceed ex-parte against him.

  The complainant filed a petition in affidavit praying for withdrawal the instant complaint case on the ground stated in the petition. Copy duly served.

Opposite Party no.1 &3 files seperate agent hazira.

 No S/R in respect of notice send to the opposite party No.2.

 In the para no.2 of the petition dated 24.12.2020 speaks that the main grievances of the complainant were against the opposite party No.1 who failed to provide adequate service to its consumer and during the pendency of the complaint case the dispute has been settled through negotiation. Complainant cleared the dues of loan account before the opposite party No.1 in terms of letter dated 30.09.2020. So the complainant has no grievances against the opposite party No.1,2 &3 at present. As such the complainant stated that there is no necessity to proceed with the complaint case being tried finally and prayed to withdraw the instant complaint case. Ld. Advocate of the opposite party No.1 &3 has no objection on that score.  Complainant files a photocopy of his identity in support of his identity.

Hearing both sides & perusing the case record this commission may not cause impediment at the pious Act of the parties as such the petition filed by the complainant deserved to allowed.      

Hence ordered that the complaint case being No.C.C.38 of 2018 be and the same is dismissed due to withdrawal.
