     Adv.Mr Bhisikar for the appellant is absent.  Adv.Mr J Vora for respondent is present.

     The present appeal is directed against the order passed by the District Consumer Forum, Yavatmal on 15.10.2008 and this appeal has been filed on 21.01.2009.  The counsel for the respondent submits that there is a delay of 37 days in filing this appeal.  The appellant has nowhere sought the condonation of the said delay in filing the appeal and he intermitantly appeared before this Commission. But he is continuously reamained absent since 02.12.2010.

     Record reflects that no application is filed to seek condone the delay of 37 days in filing the appeal.  

     Hence, we pass the following order:-

ORDER

1.   Appeal is summarily dismissed as time barred.

2.   No order as to cost.

3.   Copy of this order be supplied to the parties.
