The complainant had taken a personal loan of Rs  1,00,000/- from OP1 . The Loan was to be repaid in 36 EMIs of Rs 3812/ each. Starting from 6.12.2—6.  It is alleged by the complainant that after payment of the first installment, the OP had unilaterally enhanced the EMI to Rs 4812/-. Hence, the complaint.

          The OP has contested the complaint. It has admitted that the complainant had obtained a personal lon from it in the sum of Rs 1,00,000/- . It has however denied that the loan was to be repaid in 36 EMIs of Rs 3812/- and that it had unilaterally enhanced the EMI to Rs 4812/- . It has referred to the loan documents in this regard and has prayed that the complaint which is without any merits be dismissed.

          We have heard arguments at the bar and have perrs7ued the record.

The OP bank has placed on record the documents vide which the personal loan of Rs. 1,00,000/- was  granted to the complainant. It clearly shows that the amount of EMI was Rs 4812/- rather than Rs 3812/- as has been alleged by the complainant.  The loan was advanced to the complainant  in the year 2006 and the complainant had given PDCs to the OP bank in the sum of Rs. 4812/- each.  There is , therefore, no substance in the averments made in the complaint. The complaint is accordingly dismissed as being without merits.

          Copy of the order be made available to parties free of cost as per law.

         

File be consigned to R/R.
