BEFORE THE LOK ADALAT HELD IN DISTRICT FORUM – II

 

CONSUMER COMPLAINT NO.  408 OF  2010

 

PRESENT:

 

Sh. Vishal Gupta, Counsel for Complainant.

Sh. Sandeep Suri, Counsel for OPs.

 

Dated the 17th day of August, 2012

ORDER

 

          A compromise has been arrived at between the parties with the efforts of Lok Adalat.

 

            Sh. Sandeep Suri, Advocate for the OPs has made the following statement:-

            The OPs offer to settle the loan as fully paid if the Complainant pays a sum of Rs.13,600/- + Rs.1000/- (which were imposed as costs in cash), on or before 15.09.2012, in which case the Bank shall not claim any further amount from the Complainant. NOC will be issued to the Complainant within 15 days thereafter. However, in case of failure by the Complainant, to pay the full amount by 15.09.2012, the Bank shall be entitled to claim the full amount due.  Intimation shall also be given to CIBIL, on settlement amount being paid.”

 

            Sh. Vishal Gupta, Advocate has made the following statement:-

            I accept the aforesaid offer and hand over a cheque of Rs.13,600/-  bearing No. 301755 dated 17.08.2012, drawn on The Haryana State Co-op. Apex Bank Limited, Sector 17-B, chandigarh and Rs.1000/- in cash,.  The case be disposed off accordingly.”

 

            In view of the compromise arrived at between the parties and the fact that the Complainant has discharged his part of liability and has paid a sum of Rs.13,600/- (by way of Cheque) and Rs.1000/- (in cash), it is ordered that the OPs shall issue N.O.C. to the Complainant within 15 days from today, and also intimate the CIBIL about the settlement of the loan account. The complaint is disposed of accordingly.

 

            The parties shall be bound by the statement made before this Forum.

 

            Certified copy of this order be communicated to the parties free of cost. After compliance file be consigned.
