The respondent No.1 filed application dated 08.05.2023, stating it had no connection or relation, whatsoever the loan transaction of the complainant with the ICICI Home Finance Co. Ltd. which is a separate entity.
The complainant has given sufficient time to file reply to application dated 08.05.2023, but the complainant has not filed reply to said application and is not come forward, therefore, this Commission has no option except to proceed ahead.
The loan agreement Ex.C3 relied upon by the complainant shows, whatever the transaction pertaining to the loan was between the complainant on one hand and the ICICI Home Finance Co. Ltd. which has not been impleaded as necessary party being separate entity and on this score, complaint on its face is not maintainable. Application dated 08.05.2023 filed by the respondent No.1 is accepted and without commenting anything on merit of the case, complaint is dismissed, it being not maintainable due to non impleading of necessary party, leaving the complainant to bear his own cost of litigation. However, complainant shall be at liberty to file afresh complaint after impleading the ICICI Home Finance Co. Ltd. as necessary party. File be consigned to the records.
