ORDER

Adv.Kasture for the applicant and Adv.Vora for the Non applicant are present. This application is for restoration of the appeal bearing No.481/08 which was dismissed for default on 29/8/2008. Heard counsel for both the sides and perused the copy of the impugned order. At the outset, we may point out here that as this commission is hasving no jurisdiction to restore the appeal which is dismissed for default, this application before this commission is not at all tenable. Mr.Kasture, counsel for the applicant also fairly conceded this legal position. Hence this application stands dismissed.
