The case of the complainant is that the opposite parties even though sanctioned overdraft facilities are not allowed the said facility to use, and hence there is deficiency in services on the part of the opposite parties.
The case of the opposite parties is that the complainant has not complied all necessary facilities as stipulated including the submission of collateral securities worth 6.4 million rupees and also letter from State Bank of Travancore stating that they hold title deeds of Chaithanya Brothers. Hence there is no deficiency in services on the part of them.
3. On the side of the complainant proof affidavit and Exts.A1 to A3 documents marked. We have gone through the pleadings, documents and evidences adduced, and it is clear case where complaint has not fulfilled all necessary formalities including submission of necessary collateral security and also necessary letter pertaining to custody of original title deeds which are get in SBT. In the above circumstances, there is no deficiency of services on the part of the opposite parties and the complaint is to be dismissed.
In the result, complaint dismissed. No order as to costs.
