ORDER | Per Mr.Justice S.B.Mhase, Hon'ble President Heard Mr.V.B.Kulkarni-Advocate for the complainants files an authority letter so also pursis for withdrawal of complaint and Mr.V.Mannadiar-Advocate for opponent nos.1&2. This present consumer complaint has been filed by three complainants. However, when the complaint was heard on 13/07/2010, it was noticed that the transactions which the complainants have entered with the opponents were not in the capacity of HUF but they were separate transactions and, therefore, the order was passed that the three complainants shall file separate complaints. Ld.counsel for the complainants today makes a statement that in view of the order dated 13/07/2010 three separate complaints have been filed by the present complainants. Those are complaint nos.10/173 to 10/175. Those complaints are also on Board today, however, he submits that in view of the three complaints separately filed, this composite complaint which was filed earlier is required to be withdrawn with a liberty to prosecute individual complaints. Other side advocate Mr.Mannadiar has no objection for such course. Therefore, we pass following order:- ORDER Composite complaint no.10/74 is hereby allowed to be withdrawn with a liberty to prosecute and continue complaint nos.10/173 to 10/175 individually as against the opponents. CC/10/74 stands disposed of accordingly. Copies of the order be furnished to the parties. | |
