The case of the complainant is that he was holder of saving bank account No.62940115861 ad also having credit card facility bearing credit card No.377041633797005. The complainant was shocked and surprised to know that the OP has debited in his saving bank account the following amount without transaction in his account:-
- Rs.8,635/- dated 27.05.2008
- Rs.2,281/- dated 13/14.06.2008
On 09.02.2009, complainant visited the office of OP and inquired from it the reason for withdrawal of the above amount from his saving bank without his consent, knowledge and information. The OP explained that the complainant has subscribed an insurance policy from OP bank and the above payment has been deducted on account of premium of the said policy. It is submitted that complainant has never taken any insurance policy from the OP, therefore complainant has no liability to pay any premium to the OP bank and hence the OP has no right/authority to debit the above amount from the account of complainant. However, OP refused to reimburse the amount debited from the account of complainant despite request made by him to it. It is stated that there is deficiency in service on the part of OP. It is prayed that the amount deducted by the bank be paid and further the bank to pay Rs.1 lakh towards compensation and Rs.11,000/- towards litigation expenses.
OP in the reply stated that bare perusal of the complainant’s saving bank account statement shows that no such deductions have been made. It is denied that complainant ever visited the office of OP. It is denied that complainant was explained that he had applied for insurance policy from OP bank. It is stated that OP bank does not issue any insurance policies. It is stated that there is no deficiency in service on the part of OP.
We have gone through the record and carefully perused the written submissions of the parties.
OP has placed on record the bank statement which clearly show that on the aforesaid dates no amount as alleged in the complaint has been withdrawn rather on 27.05.08 a sum of Rs.3,400/- was credited into the account of the complainant. Complainant has not placed anything on the record to show the debit of aforesaid amount from his account. Complainant has placed on record a copy of letter dated 08.08.08 which purported to have been written by ICICI Lobard.com wherein they have mentioned that on his request, they have cancelled the policy with issue of full refund alongwith reversal of the associated charges, which would reflect on his credit card in a week’s time. It is evident from this letter that policy, if any, issued by ICICI Lombad.com, was cancelled on the request of complainant and the amount has been debited in the credit card.
As already discussed that the details of the bank statement clearly show that OP has not debited any amount as alleged by the complainant. There is no deficiency in service on the part of OP. Hence the complaint is dismissed.
Copy of order be sent to the parties, free of cost, and thereafter file be consigned to record room.
