ORDER

This complaint was filed earlier and was numbered as CC No. 90 / 2011. The said complaint came up for preliminary hearing on 26.05.2011 when this Commission after hearing the counsel for the complainant Mr. N. Rajaraman, Advocate made the following order:- fter arguing the matter at some length, learned counsel for the complainant under instructions of the complainant seeks to withdraw the present complaint with liberty to seek remedy before the appropriate court / forum. We dismiss this complaint as withdrawn with liberty as aforesaid. The present complaint based on the same cause of action and seeking the same relief and there being also no other change in the complaint has been filed on the ground that the Counsel Mr. N. Rajaraman, Advocate who argued the matter and withdrew the complaint on 26.05.2011 had no authority to do so as he had not obtained the instructions of the complainant whatsoever, the stand taken by the complainant now we must hold that the present complaint is not maintainable in view of the order passed by this Commission on the earlier complaint on 26.05.2011 reserving the right of the complaint to approach appropriate court / forum for redressal of his grievance in accordance with law. The complaint is not maintainable and as such is dismissed.
