BY THE STATE COMMISSION ( PER HON'BLE MRS. JUSTICE NISHA GUPTA,PRESIDENT):

 

This appeal has been filed against the order passed by the District Forum, Jaipur 4^th dated 20.4.2016 whereby the claim has been disallowed on the ground that complainant is not consumer.

The contention of the appellant is that the account was not for the business purpose hence, the claim should have been allowed.

 

Per contra the contention of the respondent is that no interference is needed.

 

Heard the counsel for the parties and perused the impugned judgment as well as original record of the case.

 

There is no dispute about the fact that current account was opened in the name of proprietorship firm M/s. Shyamji Petrol Pump which is evident from Ex. 7 to 9 and the Forum below has rightly held that when account was for business purpose the appellant do not fall under the definition of 'consumer' and claim has rightly been dismissed.

 

In view of the above, there is no merit in this appeal and liable to be rejected.
