Parties are present. Heard the petition and considered his submission. The petitioner submitted as to why he filed the case as none caused any annoyance to him in connection with the credit card and his Lawyer knows why he filed this case.  On scrutiny of the record this Forum finds that the case was falsely filed by the counsel without any document and now the petitioner personally produced his documents and stated that he has no grievance against bank and does not know why the Lawyers filed this case. There is no cause of action also against the O.P. who never disputes the petitioner.

Further the credit card was for the period 2001 to 2003 and then no transaction and the O.P. never stated anything to the petitioner for any payment. The petitioner does not want to proceed with the case.

Hence,

                ORDERED

That the  Complaint Case No. 76 of 2015 be and the same is  dismissed for non prosecution.
