The matter was heard on 27.01.2021.

 

Perused the supplementary affidavit filed by the complainant. By filing the instant supplementary affidavit the complainant intends to extend the period of limitation. We have perused the consumer complaint coupled with documents annexed thereto.  Fact remains that the OPs vide letter dated 20.09.2018 intimated the complainant to settle the account. The instant consumer case is filed on 18.01.2021 i.e. after expiry of two years from the date of intimation. Annexure ‘K’ of the supplementary affidavit is a statement of accounts of the OP Bank and such statement of accounts  does not extend the period of limitation to file the instant case U/s 69 of CP Act, 2019. Moreover, there is no prayer on the part of the complainant for condonation of delay for not filing the complaint within the period of limitation. Therefore, we are not inclined to admit the complaint as it is barred by limitation. Hence,

 

                                                ORDERED

 

That the consumer complaint is not admitted being barred by limitation.

 

In view of the above observation, the application U/s 34 (2) (b) of the consumer Protection Act, 2019 is not tenable and rejected.

 

Thus, MA being No. 50 of 2021 is disposed of.
