                                                            ORDER

                        The case was taken up today in the Lok Adalat. On behalf of OPs, Sh.Varinder Arora, Adv. for Sh.Manish Jain, Adv. for OPs, has appeared and filed an application stating therein that the OPs at the time of filing the Appeal No.73 of 2009 and also during the pendency of the appeal, deposited a total sum of Rs.83,045/- with the Hon’ble State Commission. Therefore, it is prayed that the total amount awarded in terms of the order dated 14.11.2008 passed by this Forum, as modifed by the order of Hon’ble State Commission dated 13.11.2009, may be released to the complainant and the balance amount may kindly be ordered to be refunded to the OP. The learned counsel for complainant has agreed with the submissions of learned counsel for OPs and made statement that total amount due as on 30.7.2010 alongwith interest as per the order dated 14.11.2008 passed by this Forum and modified by Hon’ble State Commission vide its order dated 13.11.2009, comes out to Rs.57,720/- and the said amount of Rs.57,720/- may be released to the complainant out of the amount deposited by OPs with the Hon’ble State Commission.

                        Let a request be sent to the Secretary, State Commission, UT Chandigarh, that out of the deposited amount of Rs.83,045/-, a sum of Rs.57,720/- be released to the complainant – Gurpreet Singh and the balance amount of Rs.25,325/- be released to the OP – ICICI Bank Limited and deposit the cheques in this Forum for onward transmission to the parties. However, on receiving the cheques from the State Commission, the parties be intimated to collect their cheques. The execution application stands disposed of accordingly.

                        The certificate issued to the Collector concerned under Section 25(3) of the C.P.Act is hereby cancelled and be called back

                        Copies of this order free of cost be supplied to the parties. The file be consigned.
