1.     Heard the Counsel for the Appellant, Shri Vikas Soni and Counsel for the Respondent, Shri Abhishek Kumar.

2.      Contention of the Appellant is that the complaint filed by him in District Forum (Central), Delhi was dismissed in default and for non-prosecution on 16.05.2014. 

3.      The reason for his absence on that day was that he did not appear in the District Forum with the hope that the matter shall be settled with the opposite party out of court.  In the circumstances and interest of justice, appeal is allowed setting aside the dismissal orders dated 16.05.14 and the case is remanded back to the District Forum (Central), Delhi with the directions that it shall decide the case after hearing both the parties. The Appellant/OP is directed to appear before the District Forum (Central), Delhi on 07.01.15.
