ORDER

Per Mr.Justice S.B.Mhase, Hon’ble President

This appeal has been filed by the original complainant for enhancement of compensation.  This appeal was filed on 15/6/2009.  It was placed for admission on 18/8/2009. Advocate Mr.P.B.Kulkarni has signed the order sheet in token of acknowledgement of the said date.  It appears that case appeared on 18/8/2009 for admission. No one was present, however notice before admission was issued r/o.12/2/2010.  Thereafter, case appeared on board on 16/2/2010.  On 16/2/2010 board was discharged and it was adjourned to 29/3/2010.  On 29/3/2010 Advocate Kulkarni was present.  He orally requested for time to comply the directions of supplying two additional sets of appeal memo as per rules.  However, in spite of said undertaking sets have not been submitted.  When the mater appeared on 09/6/2010 it was adjourned to 29/7/2010 i.e. today.  Thus, it would be noticed that even though notice before admission was issued on 18/8/2009, in order to serve notice, compilations have not been given.  Thereafter, he also promised to State Commission that additional two sets of compilation will be submitted.  Those have not been submitted.  Under these circumstances, appeal stands dismissed for non prosecution.
