Badhwar Cars Pvt Ltd. Vs. ICICI Bank Limited

 

Present:       Sh. S.K. Sapra, Advocate for the complainant.

                   Sh. Naveen Chaudhary, Advocate for the Opposite parties.

                   Sh. Krishan Singhal, Credit Manager for ICICI Bank Limited.

 

                   Learned counsel for the opposite parties suffered a statement that CMS charges have already been refunded back to the complainant and as per settlement arrived at between the parties, remaining charges i.e. commitment charges of Rs.73,444.16/- after deducting GST shall be refunded back to the complainant within 60 days failing which OP(s) shall be liable to make settled amount alongwith interest @9% PA from the date of order.

                   Learned counsel for the complainant suffered a statement that he has heard and agree with the aforesaid statement and has no objection if the aforesaid matter is disposed accordingly.

                   In view of the statements made by both the parties, the present complaint is hereby disposed off being settled, with direction to the opposite party to pay the commitment charges of Rs.73,444.16/- (Rupees Seventy three thousand four hundred forty four and sixteen paisa only) after deducting GST from the alleged amount to the complainant within 60 days, failing which the opposite parties shall be liable to pay interest @9% p.a. on the alleged amount from today i.e. 10.01.2024 till its realization to the complainant. Parties shall be bound by their respective statements.

                   Copy of this order shall be supplied to the parties free of cost. File be consigned to record room after due compliance.
