The instant complaint has been filed by the complainant u/s 12 of C.P. Act, 1986 praying for direction upon the Ops to replace the T.V. Set or to refund money with interest and adequate compensation along with compensation of Rs.10, 000/- for harassment and mental agony.
Complaint, in brief, is that the complainant purchased a T.V set model L.G 21FG 2 RP by paying Rs.9,500/- from the OP No.1, /S.J. Electronics on 26.09.2014 , but within two months the problem started in the T.V set. The complainant informed the OP No.2 /Sampark Service and the OP No.2 sent a personnel and he served the problem, but afterwards same thing happened another two times. At last on 16.12.2014 the complainant sent a letter to OpNo.3/L.G. Electronics India Pvt. Ltd, for taking necessary action, i.e. replacement of T.V. set or refund of entire money, but Ops are reluctant in that matter. Then the complainant was bound to come to this Forum for proper redress.
On the other hand, the OP No.1/S.J. Electronics appeared in this case by filing a petition stating that OP no.1 is only a distributor and retailer of L.G. in the district. The L.G. Electronics India Pvt. Ltd appointed Sampark Service as an authorized service centre for servicing of all L.G. products. So, this OP No.1 is not related in this matter and is praying for relief from this case.
The OP no.3/L.G. Electronics India Pvt. Ltd. , the manufacturer of the disputed product, is absent in this case, as because the notice is not duly served and returned back.
Another OP, the OP No.2/Sampark Service appeared in this case by filing a petition with intimation that the complainant and this OP negotiated with each other and the OP repaired the T.V. Set by changing the picture-tube and the complainant accepted the T.V set with satisfaction by signing the paper and has not turned up before this Forum. This shows that the dispute has been settled.
Considering the submission of all the parties, we are of the view that the case be disposed of being settled

Ordered
that the Consumer Complaint No. 48/2015 be and the same is disposed of being settled. There will be no order as to cost.
Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post to the concerned parties as per rules, for information and necessary action.
