JUDGEMENT

 

          The  factual matrix of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps    for  imposing  over due and cheque bounced charges a sum of Rs.1,00,337.39 towards finance vehicle  JCB   3DX Backhoe loader   bearing contract  agreement  No.13202 for which  the complainant  sought for redressal of the grievances raised by the complainant.

 

Upon  Notice, the O.Ps  put in their appearance and filed written version through their learned counsel  in which  they refuting allegation made against them.  The O.Ps  taking one and another pleas in the written version   sought to dismiss the complaint as it is not maintainable  under the C.P. Act, 1986. The facts which are not specifically admitted may be treated  as denial of the O.P.  Hence the O.Ps prays the forum to dismiss the case against  them  to meet the ends of justice.

During the  course of hearing the learned counsel for the complainant  has filed a memo submitted   that the complainant has filed  the above  case against the O.Ps for  imposing  over due and cheque bounced charges a sum of Rs.1,00,337.39 towards finance vehicle  JCB   3DX Backhoe loader   bearing contract  agreement  No.13202. The  complainant further  submitted   that after filing of the C.C  case the O.Ps and the complainant  are settled the matter out  side the Forum  in presence of the gentiles .     The complainant now  need  not interested to  proceed the  case further   and  prays the forum to drop the proceedings against the O.Ps. for the  best interest of justice.

       Heard  from the parties.  Perused  the   record  and  memo  filed by the complainant.  The memo is allowed.

                Accordingly the present dispute mitigated  and the  case stands disposed  off  and O.Ps wriggled out of  liabilities & the  case closed against  them    as  the  complainant   do not want to  proceed  with  the case further against the O.Ps  after settled the matter amicably out of Forum.  Parties are left  to bear their own cost.
