Present : Sh.Deepinder Singh, Adv.counsel for the complainant

Sh.Mohan Arora, Adv.counsel for the opposite party No.2

Sh.Gurpreet Singh Sandhu, Adv.counsel for opposite party No.1

Present complaint has been filed by the complainant for seeking directions to the opposite party to hand over the registration certificate of HYUNDAI VERNA vehicle sold to the complainant. On 26.7.2019, counsel for the complainant got recorded his statement that complainant has received the RC from the opposite party No.2 on 20.6.2019 and he pressed for compensation and costs.

A bare perusal of the case file shows that present complaint was filed by the complainant on 20.5.2019 and registration certificate of the vehicle in dispute was handed over to the complainant by the opposite party No.2 on 20.6.2019 i.e. during the pendency of the complaint which shows deficiency in service on the part of the opposite party No.2. Complainant was compelled to file the present complaint. As such, complainant is entitled to compensation and costs. As such, present complaint is disposed of with directions to the opposite party No.2 to pay compensation of Rs.3000/- and litigation expenses of Rs.2000/- to the complainant within 30 days from the date of receipt of copy of order; failing which proceedings u/s 27 of the Consumer Protection Act shall be initiated against the opposite party No.2. Copies of the order be furnished to the parties free of costs. File be consigned to the record room.
