The parties have appeared and made statement, which is reproduced as under: “Statement of Sh.Vishal Gupta, Advocate for OP No.1 & 2. The OP No.1 & 2 have paid the amount as per the order dated 27.10.2010 passed in CC no.315 of 2010. The OP No.1 & 2 however, reserves the right to get the cheque No.831593, dated 7.12.2010 amounting to Rs.9300/- cancelled which was earlier issued in the name of complainant. Statement of Sh.K.K.Midha s/o Sh.B.L.Midha, Husband/Auth.Representative of Complainant. I have gone through the above statement given by the counsel for OP No.1 & 2 and accepted it as correct. My execution application may kindly be dismissed as fully satisfied. Received Rs.5000/- (Five Thousand Only) in lieu of cheque issued by the company OP 1 & 2 against cheque not received & returned to the party by the courier” 2. Keeping in view the above, since the complainant has made statement for dismissal of the execution application as satisfied, the same is allowed and the execution application is dismissed as withdrawn. 3.
