The case is fixed for Argument. After hearing Argument from both sides the Commission proceeds to dispose of the case as hereunder: -
The Complainant’s case is that he invested money with O.P. and obtained five certificates as follows: -

After the Maturity Period the Complainant approached the O.P. for return of the same but of no effect. The Complainant has therefore approached this Commission claiming Maturity Value for Rs.2,15,302/- against the above mentioned five certificates with compensation.
O.P. contested the case by filing a written version denying material allegation made in the petition of complaint with the prayer for dismissal of the case.

-: Decision with reasons: -
Having regard to the facts of the case, submission, contention and documents on record on both sides the Commission finds from the five certificates issued by the O.P. that the Complainant is entitled to get return of the matured value of Rs.2,15,302/- accruing from the aforesaid five certificates and the O.P. cannot have any defence to disown their liability and bypass the same.
At the time of hearing Ld. Advocate appearing for the O.P. has however candidly submitted before the Commission that the O.P. is not in a mood to deny their liability to repay the matured value to the respective claimants like the Complainant and in furtherance of such repayment process the Govt. of India has already opened a portal for payment to Sahara depositors from the Sahara Co.
The Complainant is at liberty to take recourse to such portal in order to satisfy the decretal amount as hereinbelow passed by this Commission. Accordingly without prejudice to the mechanism of repayment to the claimants as set up above the Commission hereby passes the following order.
Hence it is ordered……..
That the case be and the same is allowed on contest against the O.P. but without cost.
The O.P.s are directed to pay to the Complainant Rs.2,15,302/- as the Maturity Value of the five certificates mentioned hereinabove with compensation of Rs.20,000/- within a month from this date in default law will take its own course.
Both parties be supplied copy of this Judgement free of cost.
