Final Order / Judgement

ORDER

20.12.2017

S.K Sinha, President

The order dismissing the complaint is under challenge.

2.                 The complainant basically alleged that for running his ATTA Chakki instead of the load of 15 KW supply of 19 KW was connected on taking additional security money of Rs. 7,200/-. The electric bill for the month of August and September, 2015 was on the basis of 19 KW load issued and paid by the complainant. The complaint was filed for returning the amount of Electric Bill on the difference of 15 KW and 19 KW with compensation since the load of 19 KW was not required and the concerned official of the electricity Board under pressure provided the electric load at 19 KW. On behalf of the Respondent (O.P) the allegations were denied. It was stated that the agreement was entered for 19 KW. The electric bill were accordingly issued which was paid. No subsidy was available as per the extant policy of the State Government. The required additional security money was deposited by the complainant for 19 KW of load.

3.    The District Forum upon considering the relevant papers filed by both the parties including the copy of the agreement between complainant and the Board dismissed the complaint upon holding that there is no material on the record to substantiate the electric connection of 19 KW was illegally provided. To the contrary complainant deposited additional security money of Rs. 7,200/- for the load of 19 KW.

4.       Written notes of argument filed on behalf of both sides including rejoinder on behalf of the appellant.

5.        We have considered the case of the parties, as also the impugned order and respective written notes of argument. Upon considering the entire matter we find that the fact of agreement for availing electric connection of 19 KW, deposit of additional security money the inspection by the official of Board to assess the requirement of electric energy in respect of the Machines in the premises of the complainant are not disputed. The allegation that electric connection of 19 KW and deposit of additional security money of Rs. 7,200/- was under dispute could not be substantiated, more so complaint is availing electric energy to run his Machines. The District forum has considered the matter in correct perspective. However, the appellant may file application for decreasing the load.

6.  In the result appeal stands dismissed.
