ORDER NO. 9 DT. 22.4.09

Appellant is absent without taking any steps.  Ld. Advocate on behalf of the Respondent no. 1, Mr. A.Dutta, is present.  We find that on previous two dates the Appellant was absent.  It seems that the Appellant is not desirous of pursuing the present Appeal properly and has not filed any show-cause as was ordered. Today is the date fixed for showing cause by the Appellant.  In view of the present circumstances we have no alternative but to order that the Appeal stands dismissed for non-prosecution.
