2. Goibibo 19^th floor, Tower-A,B & C, Epitome, building No.5, DLF Phase-2, Sector-24, Gurugram, through its MD.

Complaint under Section 35 of Consumer Protection Act, 2019.

Present:  Sh. Balwinder Singh, counsel for the complainant.

                OP-1 exparte vide order dated 10.03.2023.

                Sh. Apaar Singh Bedi, counsel for the OP-2.

               

                                 Today the case is fixed for evidence of the complainant, subject to the second last opportunity. No evidence is present. Request for adjournment. Strongly opposed. On perusal of the file, it reveals that complainant has already availed several effected opportunities including two last opportunity to conclude his evidence but he failed to do so. It appears that complainant is no more interested to pursue his case. The present complaint pertains to the year 2022. Further adjournment for the same purpose would not be justified at it would amount to wastage of precious time of this Commission.

                Hence, in view the above facts, the present complaint is hereby dismissed. However, complainant is at liberty to file fresh complaint on the same cause of action in the court of competent jurisdiction, if so desired. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
