Sh. Vimal Chandra – appellant has appeared in person.

Today an application (paper No. 45) alongwith ID of     Sh. Vimal Chandra – appellant has been submitted stating that he does not want to contest his appeal, hence it shall be dismissed.

Sh. Pradeep Kumar Sharma - Managing Director of respondent – Hotel Gardeniya Spa and Resort has appeared in person.

A perusal of the impugned judgment has also revealed that the complaint in the District Commission was also dismissed and in the appeal, the appellant – complainant does not want to contest his appeal.

In such circumstances and on the basis of such application (paper No. 45) the appeal is hereby dismissed.  No order as to costs.

File be consigned to the record room alongwith copy of this order.

A copy of this order be forwarded to the District Commission concerned for perusal and necessary information.
