Final Order / Judgement

Sri Anupam Bhattacharyya, Presiding Member.     

            The instant complaint case is praying for compensation of Rs.18 Lakhs for death of complainant’ s father for negligence of the District Hospital, Murshidabad and for Rs.1 lakh for mental pain and agony and Rs.20000/- towards litigation cost.

            The complainant’s case is that his father died on 24.04.2006 for negligence of the District Hospital and the case filed on 06.06.2016 after ten years two months. At the time of death of his father, the complainant was minor.

            From the complaint petition it appears that on 22.04.2206 at 06:25 A.M. Uttam Mondal, deceased father of the complainant was admitted to Barwan Rural Hospital with severe bellyache wherefrom on the same day transferred to Kandi Hospital in the evening and again at late night on 23.04.2206 transferred to District Hospital, Murshidabad and getting satisfactory assurance the family members of the patient returned back to their residence at a long distance at Jugswera. On 24.04.2006 Barwan P.S. informed the complainant’s family that Uttam Mondal met with an accident on the right hand side of footpath of Bhagirathi Bridge at Berhampore and died on that day at 01:00 A.M. Nobody released Uttam Mondal from the District Hospital, Murshidabad.

            After death of father, the complainant for the first time sent an R.T.I. to Op No.3 for information about cause of death of his father but no reply.

            Sufficient opportunities have been given to the complainant for admission hearing for showing sufficient cause for condonation of delay and also for referring reported decision in their favour.

            But, the complainant has failed to establish sufficient cause for such delay and/or any reported decision in this regard in favour of the complainant for admitting the case for hearing.

            Considering the above discussions, we have no other alternative but to dispose of the case being not admitted.

Hence,

                                                                                   Ordered

that the Consumer Complaint No. 91/2016 be and the same is disposed of being not admitted.

Let a plain copy of this order be made available and be supplied free of cost, to the complainant by hand under proper acknowledgment / be sent forthwith under ordinary post, for information and necessary action.
