Final Order / Judgement

     This is a complaint filed under section 12 of Consumer Protection Act, 1986 to direct the opposite parties no.1 and 2 to refund a sum of Rs.7,66,000/- towards the price of the vehicle and interest thereon at the rate of 18% p.a from 25.09.2014, the date of purchase of the vehicle by the complaint till payment and discharge by the Opposite Party under section 14(c) of the Consumer Protection Act, (b) to direct the Opposite Parties to either jointly or severally pay the Complainant compensation of Rs.15,00,000/- for the physical hardship & suffering, mental agony and monetary loss caused to him due to Opposite Parties' unfair trade practice and deficiency in service under section 14(d) of the Consumer Protection Act and (c) to direct the Opposite Parties to pay the complainant a sum of Rs.20,000/- towards litigation expenditure and cost of the complaint.
     2. Notice was issued to the opposite parties. The opposite parties 1 to 3 appeared through their Counsel and filed their reply version.
     3. Today when the case came up for hearing, the counsel appearing for the complainant reported 'no instruction' from the complainant. On verification of documents, it seems that this complaint has been filed claiming compensation of Rs.15 lakhs and further for directing the Opposite parties to pay a sum of Rs.7,66,000/- alongwith interest at the rate of 18% per annum and also claimed Rs.20,000/- as litigation expenses. Otherwise, in order to prove the claim filed by the complainant, he has not come forward to let in evidence and also not produced substantial documents to prove his claim. Therefore, in the absence of any document to show that the OPs are liable to pay the claim claimed by the complainant, it cannot be said that the complainant has proved his case. Therefore, in view of the above, the complaint is dismissed for default.
     In the result, the complaint is dismissed for default. No costs.
