         Both parties are present. Today is fixed for W/O.

Complainant files a petition stating that the matter has been settled by and between the parties and the Complainant is willing to withdraw the case and he is not willing to proceed with the case.

The Op. files a petition regarding the payment which has been paid to the Complainant. The Op. has refunded Rs. 1895/- against a defective Jeans Pant to the Complainant. So the Complainant is not ready to proceed with the case and prayed for dismissal of the case.

      Hence,

                  it is ordered that

                                              The case is dismissed for non prosecution of the case.
