          Today is fixed for filing E/chief by the complainant .

Neither the complainant is present nor he is represented by Advocate. Complainant fails to file E/chief . There is no prayer on the part of the complainant for extension of time to file E/chief. Ld. Advocate for the OP 2(a) is present. He submits that complainant has no interest to proceed the case any further. Accordingly, he prays for dismissal of the complaint.

Heard the Ld. Advocate for the OP 2 (a). Perused the record. Admitted fact is that the complainant fails to file E/chief on second call. Therefore, we are of the opinion that the complainant is not interested to proceed the case any further. Accordingly, the complaint is liable to be dismissed .

Hence,

ORDERED

That the complaint case be and the same is dismissed for default but without any cost.

Later-

Date-18/04/2019.

After the order was passed today, E/Chief is filed by the complainant. An application U/S 25 of the C.P Act is also filed by the complainant and the same is registered as MA/196/2019.

It appears that the complaint case was dismissed for default in earlier order today for not taking steps of the complainant and as such the application being no. MA/196/2019 calls for no consideration and hence it is rejected.

The E/Chief filed by the complainant just now be kept with the record.
