                 Before passing any order disposing of the present appeal, it is necessary to mention that earlier the present appeal was dismissed by this Commission on the point of limitation vide its order dated 18.09.2013. The said order was challenged by the appellant before Hon’ble National Commission by filing a Revision Petition bearing RP No.4737/2013. Vide order dated 06.11.2015, Hon’ble National Commission set aside the order passed by this Commission subject to payment of costs of Rs.5,000/-.

                 After passing of the aforesaid order, the matter was listed before this Commission on 14.12.2015, however, the appellant did not make the payment of costs to the respondent/complainant. Thereafter, further costs of Rs.3,000/- was imposed upon the appellant vide order dated 25.05.2016. However, the appellant has failed to make payment of the aforesaid costs till date.

                 It is stated that counsel for respondent/complainant that more than five years have lapsed till date appellant/OP has not complied with the order passed by the National Commission and this Commission and prayed dismissal of the present appeal for non-compliance of the aforesaid orders. 

                 I have perused the records, since the appeal was restored subject to payment of costs, which has not been paid by the appellant till date, present appeal stands dismissed for non-compliance.

                 File be consigned  to Record Room.
