ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

                                                                                             JUDGMENT

            Complainant has filed this consumer complaint U/s.12 of C.P. Act, 1986 seeking following reliefs;

            “Direct the opposite party not to sale/ auction the asset (Motorcycle) bearing No.OD-05-AC-9509 and release the asset without any additional charges by receiving the defaulted amounts and pay cost of the proceeding Rs.10,000/- & Rs.5,000/- towards compensation for mental agony and harassment”.

            Complainant is regularly absent and has not taken step since June, 2020. We have gone through the records and found that the cause of action arose not within the territorial jurisdiction of this Commission as such opposite party being not within the jurisdiction of this Commission, this Commission lacks jurisdiction to entertain this application. Accordingly the consumer complaint is dismissed for want of jurisdiction. However liberty is given to complainant to file fresh consumer complaint before appropriate Forum as on the date of cause of action as per prevalent rule available then. No cost.
