Heard Mr. R.K Mour, learned cowqunsel, appearing for the  petitioner in the Misc Case for condonation of delay. Office note dated 09-09-2013 indicates  that A/D card has returned from the respondent after due service and we have verified from the record and therefore, notice upon the  respondant shall be deemed to have been completed.

           We have perused the explanation given in para 3 &4 of the application and we are satisfied that the petitioner was prevented from filing the  connected appeal in time, therefore , the  delay of 8 days  is hereby condoned.

         Misc case stands disposed. In view of disposal of this Misc case, Registry shall allot a number to the pending appeal and the same shall be  listed for admission on 3-10-2013
