ORDER

JUDGEMENT & ORDER

The complainant was represented by his brother Tung Tayeng. He submitted that complainant has purchased a ticket for the winger service from Himalaya Tour & Travels, Pasighat to go to Itanagar from Pasighat on 10.02.2013 and paid Rs. 350/- being the cost of ticket.

The winger did not pick him up though he requested over phone to pick him up from 5^th Mile pick-up point. Instead, the driver of the vehicle asked complainant to come over to Ruksin Check Gate. Due to negligence of the travel Agency, the complainant could not go to Itanagar and as such he failed to attend his duty on time.

Heard owner of the Himalaya Tour & Travels, Mr. Tapang Darang. He submitted that the Driver of the Winger vehicle conveyed him that the complainant could not be picked up from 5^th Mile as he was not available there.

From the version of both the parties, it appears to the Forum that the complainant rang up the owners of Himalaya Tour & Travels to pick him up from 5^th Mile and the owner admit the conversation and failed to discharge his duty.

Therefore, the Forum is of the opinion that the travel agency Himalaya Tour and Travels and the driver of the Winger vehicle put the Complainant in trouble by causing him to break his journey on that day and made him to remain absent from his duty.

Therefore, the owner of the travel agency Himalaya Tour & Travel is directed to refund the fare i.e. cost of the ticket Rs. 350/- along with a compensation of Rs. 1000/- to the complainant within six week for giving unnecessary harassment to the passenger.

Direction pronounced in open court.

Copies of this order be given to both the complainant and respondent.
