Present:-  Complainant in person.

Complainant is alleged to have purchased a TV manufactured by OP No.2 (Sony India Pvt. Ltd.) in the year 2008.  It was given for repair on 5/5/2014 to OP-1 (M/s Hi-End Solutions, the authorized service center of Sony India).  The product was purchased in the year 2008.  We have specifically asked the complainant as to what was the warranty period.  He submits that the same must have been given in the invoice.  However, there is no such clause in the cash memo/invoice  dated 23/10/2008 filed along with the complaint.   The warranty card has not been produced by the complainant.  The TV was purchased in October, 2008 and the warranty seems to have expired.  Case of the complainant is that he had given the TV to M/s Hi-End Solutions (OP-1) for repairs which it has not returned despite the fact that considerable time has elapsed.  He has also submitted that he had visited the OP-1 several times and he was informed that the part, which is defective, being of old model is not available in the market and as soon as the same is available and is arranged, the same shall be replaced and complainant would be informed.  It is not the case of the complainant that he wanted to take his TV back and the same has not been returned by O.P.  When the replacement to the defective part of outdated model of TV is not available in the market and OP-1 is ready to make the replacement/repair as soon as the same is arranged, in our opinion, there is no deficiency on the part of OP No.1 (M/s Hi-End Solutions).   Complaint does not disclose any consumer dispute.  The same is, therefore, dismissed.  File be consigned to record room.
