By G. Yadunadhan, President: The case of the complainant is that he had purchased a chappal from the opposite party’s shop for Rs.850/-. After lapse of a week it was damaged. This fact was intimated to the opposite party. But the opposite party was not prepared to replace the same. Therefore complainant is seeking relief against the opposite party to replace the chappal as defect free and also to pay a compensation of Rs.10,000/-. After serving notice, opposite party called absent and set exparte. Complainant filed affidavit and he was examined as PW1. Ext. A1 was marked on the side of the complainant. From the affidavit and Ext. A1, complainant’s case is proved. In the result petition is allowed and the opposite party is directed to repay an amount of Rs.850/- towards the value of the chappal and also to pay a compensation of Rs.1000/- along with a cost of Rs.250/- to the complainant.
