None appears for the appellant.  This matter pertains to the year 2014 filed under Section 27(A) of Consumer Protection Act, 1986 aggrieved by the order dated 04.03.2014 passed by District Forum, Dharwad in E.A.No.25/2013.

It is found from the proceedings dated 07.01.2016 that respondent is willing to settle the matter amicably and infact counsel for respondent has brought D.D. on many occasions, but, none appears for the appellant / complainant and it was directed to send D.D. through RPAD to appellant.  It is also not forthcoming amicable settlement of dispute between parties.  Further on this day counsel for respondent is present and submits that an amount of Rs.5,927/- is said to have been paid.  Whether it is paid or not, since, appellant remained absent, in such circumstances, this appeal could not be kept pending at the same stage.  In the result, we proceed to dismiss the appeal for default and non-prosecution or as settled as submitted by counsel for respondent.
